Consulting Services

Acquisition of Liquor License – Due to quota limits based on population, licenses have become increasingly limited to obtain directly from licensing authorities.  In some states, this has required additional liquor license purchases and creativity to determine the best option to acquire a license.  We can provide the following to assist with acquisitions:

• Identify and negotiate the purchase of liquor licenses
• Assist with resolving issues involving license purchases with taxes due and in bankruptcy
• Identify and apply for newly issued licenses through lottery drawings and auctions
• Identify possible ordinance changes to allow for additional liquor licenses to be released for issuance
• Resolve distance restriction and objection issues related to the proximity of churches, schools, etc.
• Provide assistance with initiating local option elections in areas designated as “dry” for alcohol sales

License Processing – Each state and many municipalities within certain states have various processing requirements for acquiring liquor and operating licenses.  Ensuring the timely submittal of complete applications and required attachments is critical to obtain approvals to meet your contractual contingencies and scheduled opening dates.  On many occasions, questions related to specific processing requirements (i.e., fingerprinting, financial and personal information on officers, etc.) must be carefully reviewed and questioned as to applicability.  We will make every effort to limit the amount of personal and financial documents provided to licensing authorities and expedite the processing of your application.

Business Openings - There are numerous issues involved with the opening of a business selling alcohol.  In most cases, other licenses, approvals and final inspections must be obtained prior to the issuance of your liquor license.  This can include health, fire, zoning, sales tax permits, certificate of occupancy, and other requirements as determined by licensing authorities. We will coordinate requirements and inspections with your construction project manager, location managers and all licensing authorities to help ensure the issuance of all licenses.  While processing the issuance of your licenses, we will continually communicate the status of your licenses and critical operating requirements to your management staff, project manager, and others as requested.

License Renewals and Maintenance - Most licenses need to be renewed annually and some more often depending on municipality requirements.  We have the ability to monitor renewal dates and make sure the proper applications and fees are paid to avoid any late fees or license cancellations due to a lack of payment.

License Feasibility Report – There are many issues that can impact the acquisition of a liquor license and the feasibility of continuing with the development of a business.  This report will provide you with comprehensive information on the availability, cost, requirements and restrictions of acquiring a liquor license as follows:

• If a purchase is required, are licenses available
• Distance restrictions and methods of measurement from churches, schools, other licensed establishments, etc.
• Determine if proposed site allows alcohol sales seven days a week
• Allowed hours of operation
• Time frame to process application or complete due diligence to determine probability of license approval
• Age requirements and alcohol awareness training/permits for employees
• Restrictions on license that could limit the normal operation of your business
• Design restrictions for business (i.e., alcohol storage, etc.)
• Additional issues that could affect your license approval or business operation
